Effective Date: January 7, 2025
These Terms of Service ("Terms") govern your access to and use of the helmtk website, software, and services (collectively, the "Services") provided by Triple Twenty LLC ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
helmtk provides a toolkit for Helm chart maintainers, including a structured template language and compiler, a test framework, a decompiler service, a VS Code extension, a web-based playground, and related documentation and resources.
Open Source Components. The VS Code extension and htkl library are made available under the MIT License. The full text of the MIT License is available at https://github.com/helmtk/helmtk-vscode/blob/main/LICENSE and https://github.com/helmtk/htkl/blob/main/LICENSE. Your use of the open source software is governed by the terms of that license.
Commercial Use. Use of helmtk for commercial purposes requires a commercial license. Commercial use includes, but is not limited to, use by or on behalf of a for-profit entity, use in connection with revenue-generating activities, or use in a commercial product or service. Commercial licenses are available as described on the install page. The commercial license grants you a non-exclusive, non-transferable right to use helmtk for commercial purposes during the license term.
The helmtk decompiler is a paid service that uses a large language model (LLM) to translate existing Helm charts into helmtk format. By using the decompiler, you agree to the following:
Pricing. The decompiler is priced based as described on the install page. Pricing is subject to change with notice.
Code Submission. When you use the decompiler, your Helm chart code is transmitted to our servers for processing. You represent and warrant that you have the right to submit any code you provide to the decompiler service.
No Guarantees. The decompiler output is generated by an LLM and may contain errors or require manual review and correction. We do not guarantee that the output will be accurate, complete, or suitable for any particular purpose.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update your information as necessary.
Payments are processed through third-party payment processors. By making a purchase, you agree to the payment processor's terms of service. All fees are non-refundable except as required by law or as expressly stated in these Terms.
You agree not to use the Services to violate any applicable law or regulation; infringe the intellectual property rights of others; transmit malware, viruses, or other harmful code; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the Services; use the Services for any fraudulent or deceptive purpose; or resell, redistribute, or sublicense the Services without our prior written consent.
We reserve the right to suspend or terminate your access to the Services if we reasonably believe you have violated these Terms.
Our Property. Except for the open source components licensed under the MIT License, the Services and all content, features, and functionality (including but not limited to the website design, text, graphics, logos, and trademarks) are owned by helmtk and are protected by intellectual property laws.
Your Content. You retain ownership of any code or other content you submit to the Services. By submitting content to the decompiler service, you grant us a limited license to process that content solely for the purpose of providing the service to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HELMTK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless helmtk and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the effective date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 6 through 10 shall survive any termination of these Terms.
Entire Agreement. These Terms, together with the Privacy Policy and any applicable license agreements, constitute the entire agreement between you and helmtk regarding the Services.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
